1. Payment Terms & Refund Policy
- Advance Payment Required: Transportation services provided by Triangle Access will not commence until payment is received in full from the contracting party.
- Non-Refundable Policy: All payments for transportation services are strictly non-refundable. Because Triangle Access reserves dedicated vehicles, drivers, and route capacity based on paid enrollment, refunds or credits are not issued for days missed due to student illness, personal scheduling changes, family vacations, or unexpected school closures.
- Remittance of Payment: If invoices are not paid by the due date, a late fee of $20 will be added to the current balance due.
- Late and/or Unpaid Invoices: When an invoice remains unpaid by the contracting party, surpassing the invoice due date, a $20 late fee will be applied weekly until said balance is paid in full, by the contracting party.
2. Planned Absences ("Hold the Seat" Fee) To accommodate temporary, planned absences (such as family vacations) while maintaining route placement:
- Advance Notice: Parents/guardians must provide at least one (1) week of written notice prior to the planned absence.
- Holding Fee: A fee equal to 50% of the standard weekly transportation rate is required for each skipped week to retain the student's assigned seat.
- Route Security: Remitting this fee guarantees the student's seat is not reassigned to a waitlisted family and covers ongoing fixed operating costs.
3. Unexcused Absences & Service Termination
- Unpaid Absences: If a student does not attend and the "Hold the Seat" fee is not paid in advance, Triangle Access reserves the right to immediately terminate transportation services.
- Seat Abandonment: Following five (5) consecutive business days of absence without formal notice and payment, the seat will be declared forfeited and released to the next applicant on the waiting list.
- Re-Enrollment: Reinstatement following termination is subject to seat availability, current route capacity, and payment of a new registration fee.
4. Inclement Weather & District Closures
- District Schedule Alignment: Triangle Access follows the official closure and weather delay schedules of the student's respective county school district (Wake, Johnston, or Durham County).
- Automatic Service Suspension: If the designated school district cancels classes or transitions to remote learning due to weather, transportation services are automatically suspended.
- Force Majeure: No refunds, credits, or makeup days are provided for weather-related cancellations or conditions beyond company control. Any exceptions remain at the sole discretion of Triangle Access Management.
5. Service Agreement & Cancellation Policy
- Agreement Formation: Accessing, booking, submitting inquiries, or remitting payment through the Triangle Access digital platform forms a legally binding service agreement between the contracting party (parent, legal guardian, or court-appointed representative) and Triangle Access. Use of our services or digital platform constitutes full acceptance of these terms.
- Cancellation Procedure: The contracting party may terminate service at any time by providing written notice via email or formal confirmation.
- Earned Fees: Once billed and processed, fees for the current billing cycle are fully earned by Triangle Access and non-refundable, regardless of whether the student utilizes the remaining scheduled rides.
6. Vehicle Safety & Child Restraint Systems
- Equipment Requirement: Triangle Access does not supply supplementary seating equipment, including infant seats, convertible car seats, or booster seats.
- Parent/Guardian Responsibility: If a student is required by North Carolina state law or parental request to utilize a child restraint system, the parent or guardian is solely responsible for providing an approved, age- and size-appropriate seat prior to transport.
- No Restraint, No Transport: Triangle Access will immediately refuse transportation to any student lacking the required restraint system at pickup. Missed rides resulting from missing or improper equipment are non-refundable.
